The National Labor Relations Board

Last week, the US Supreme Court heard arguments in Noel Canning, a case that found the President's three recess appointments to the National Labor Relations Board (NLRB) were unconstitutional. This controversial case threatens the validity of hundreds of decisions, as the Court may determine that the NLRB did not have the authority to issue decisions and enforce the National Labor Relations Act, which prohibits employers from engaging in certain conduct that interferes, restrains, or coerces employees in the exercise of their rights.
