Increased governmental enforcement can certainly be nerve racking for an employer, even one with best in class compliance efforts. The US Department of Labor (DOL) and Equal Employment Opportunity Commission (EEOC) are continuing their stepped-up enforcement efforts. Last week alone we covered the EEOC's focus on persecuting gender discrimination and the DOL's recent settlement in a significant Family and Medical Leave Act (FMLA) lawsuit with $50,000 in back wages and significant other compliance measures. State labor agencies, such as California's, are beefing up enforcement, too.
More broadly, President Obama recently requested $243 million for the Wage and Hour Division (WHD) of the DOL, which is responsible for enforcing the Fair Labor Standards Act (FLSA), the FMLA and other statutes. This would be an increase of about $15 million over the previous fiscal year to be used primarily for enforcement efforts.
