State Highlights
XpertHR Adds 2 States to its Rapidly Expanding Coverage!
XpertHR is on track to have all 50 states and Washington DC in July. We are completing states on a rolling basis until then and are now up to 31 states, with the completion of two states in the past week. Delaware Passes Temporary Mini-COBRA Law
The State of Delaware enacted a temporary Mini-COBRA law, joining several other states that require continuation of coverage for employees in small employer group health plans.
Supreme Court Rules on Arizona's Immigration Law
The Supreme Court has now ruled on several provisions of Arizona's Immigration Law in Arizona, et al. v. United States, 2012 U.S. LEXIS 4872 (June 25, 2012). In a 5-3 decision, the Court struck down three provisions while upholding one.
Dignity For All Students Act Goes into Effect in New York State on July 1, 2012
The law provides that no student shall be subject to discrimination or harassment on the basis of the student's actual or perceived race, color, weight, national origin, ethnic group, religion, religious practice, disability, sexual orientation, gender (including gender expression), or sex.
Gender Identity Is Now a Protected Class in Massachusetts
On July 1, 2012, the Transgender Equal Rights Bill went into effect in Massachusetts. The law explicitly prohibits discrimination and harassment based on gender identity in employment and specifically amends the Massachusetts Fair Employment Practices Act to include gender identity as a protected category.

Supreme Court Upholds Affordable Care Act - Business as Usual for Employer Group Health Plans
After much anticipation, the Supreme Court ruled, in a 5-4 decision, that the individual mandate provision in the Affordable Care Act is considered a tax and is therefore constitutional. The Court also ruled that the expansion of Medicaid is constitutional, but that existing funds cannot be withheld from states for noncompliance.
Updated Guidance for Employers With Respect to Social Media Based on Recent NLRB Reports
The National Labor Relations Board recently provided guidance for employers who are drafting social media policies and disciplining employees regarding social media use in the form of three reports issued in August 2011, January 2012 and May 2012.

Editorially we attended over 20 timely sessions including several addressing the evolving role and compliance challenges of social media, a number focusing on HR's continuing challenge managing employee leaves, and employee handbook updates and pitfalls.
