State Highlights


New Illinois Law Addresses Privacy Rights of Applicants and Employees With Regard to Social Networking Websites
On August 1, 2012, Illinois Governor Pat Quinn signed a new law, HB 3782, which amends the Right to Privacy in the Workplace Act and makes it unlawful for an employer to ask a job applicant or employee their user name and password for the purpose of gaining access to that individual's private social networking account or profile.


New E-Verify Law in Pennsylvania
On July 5, 2012, the Governor of Pennsylvania signed into law the Public Works Verification Act, which takes effect January 1, 2013. The Act requires contractors and subcontractors on public works projects with an estimated cost that exceeds $25,000 paid in whole or in part from a public body, to verify that their workers are authorized to work in the US by using E-Verify.


Connecticut Medical Marijuana Law Breaks New Ground
Connecticut will become the 17th state to legalize the use of medical marijuana with a new law that is set to take effect on October 1. But the Constitution State stands apart in one notable respect.



Is workplace bullying against the law?


An employer may be held liable for workplace bullying or harassment under both federal and state laws if the bullying or harassment is found to have occurred because of an employee's legally protected characteristic such that the individual is a member of a protected class. Presently there are no federal laws that prohibit workplace bullying or harassment that is not related to a protected class. Read more...

Summer is winding down and people are returning from vacations. The heat and humidity plaguing much of our country is easing, at least in some parts of the country! However, our summer at XpertHR has been quite busy as we've completed our coverage of the employment law requirements in all 50 states and their municipalities, and for Washington, DC. What a monumental undertaking - and how rewarding to see it all published and ready to help our growing list of subscribers.

Of course, just publishing the materials is not nearly enough. Our priority now is to ensure that you always have the most current information, for every state, at all times! We have already been updating our coverage to address the flurry of state legislation regarding social media password privacy, Connecticut's recent medical marijuana law, and Pennsylvania's new e-verify law - to name just a few of the recent state developments. We've covered many others already...our editors will keep you apprised of ALL employment law developments among all the states to help ensure you're current with your compliance efforts.
