Limiting Criminal History Questions
A notable trend in the preemployment screening arena is the growing number of states and cities prohibiting employers from asking criminal history questions on initial job applications.
Many employers use job applications on which candidates are asked to check off a box if they have ever been convicted of a crime. Such questions leave no room for explanation and often serve as an automatic bar to further consideration. What's more, statistics show their use tends to disproportionately screen out minority applicants.
States and municipalities have responded by passing so-called "Ban the Box" laws to ban these criminal history questions. XpertHR has a Ban the Box chart for employers to reflect these developments, which typically do not prevent background checks later in the hiring process.
