Layoffs
With the fourth fiscal quarter of the year on the horizon, employers should plan ahead for the termination of calendar-year employees. Preparing for employee terminations requires conducting exit interviews with outgoing employees; processing post-termination benefits; handling employee questions and concerns; and training regarding the best methods to conduct termination meetings. The Employment Law Manual section on the Process of Termination covers all of this information in depth, enabling employers to develop robust termination protocols that ease the transition for outgoing employees and guard against post-termination risk for employers.

Municipal law is a real challenge for employers, particularly recently given trends in municipal paid leave (NYC, Seattle, Portland OR). In addition, a number of municipalities have passed laws that protect lesbian, gay, bisexual and transgender (LGBT) rights, such as sexual orientation and gender identity. Many of the nation's largest cities have enacted "ban the box" laws prohibiting employers from asking applicants if they have been convicted of a felony on job application forms.
